WATER RIGHTS WORK GROUP

During the LDCC JPB Meeting on October 18, 2012 the LDCC Board voted to move forward in establishing a three party coordinated group to negotiate the water rights currently held by LDCC JPB.  The group is to consist of one appointee from LDCC JPB, one from Johnson County and one from Sheridan County.  LDCC JPB appointed David Garber to represent the Board.  During a Special Meeting on October 22, 2012 Johnson County appointed John Gibbs as their representative.  During a Special Meeting on October 22, 2012 Sheridan County appointed Mike Nickle as their representative.  The group will coordinate a series of at least 2 meetings followed by a Special Public Meeting to present negotiations.

The Water Rights Work Group met in a closed meeting on October 25, 2012.

On October 30, 2012 Johnson County Commissioners held a Special Meeting to discuss and present negotiations (proposals) agreed upon by the Water Rights Work Group.

On October 30, 2012 Sheridan County Commissioners held a Special Meeting to discuss and present negotiations (proposals) agreed upon by the Water Rights Work Group.  Sheridan County also unanimously voted to move forward with “Proposal #2″ during the Special Meeting on October 30, 2012.

October 30, 2012 LDCC JPB held a Special Meeting to discuss and present negotiations (proposals) agreed upon by the Water Rights Work Group.  After hearing the public comment.  Chairman Garber individually polled the Board for:  A) Retain the LDCC JPB and jointly move forward with the proposed WY Game & Fish Lease.
OR
B) Move forward with the Water Rights Work Group Proposal #2.  Vice-Chairman Rhodes, Treasurer Todd, Secretary Rolston, Board Member Clarendon were in favor of Poll A to retain the LDCC JPB and jointly move forward with the proposed WY Game & Fish Lease.  Board Member Eitel was in favor of Poll B Move forward with the Water Rights Work Group Proposal #2.

Chairman Garber conducted polling so did not cast his favor, however did voice that his preference was for Poll A.

Chairman Garber agreed to schedule another meeting with the Water Rights Work Group after Johnson County had established their position/direction in a public meeting.

Johnson County Commissioners are holding a Special Meeting on Thursday
November 1, 2012 at 5:30 pm to discuss Water Rights at Lake DeSmet.

Johnson County added to their Agenda today (November 7, 2012) the Dissolution Agreement.  It was approved and forwarded to Sheridan County for their consideration.  Sheridan County has scheduled a Special Meeting regarding the Dissolution Agreement (attached) for tomorrow, November 8, 2012 at 8:30 am.

LDCC MARKETING REVIEW COMMITTEE

A Marketing Review Committee was appointed by the LDCC JPB on November 17, 2011.   The purpose of the Committee is reviewing water modeling data, assessing marketing options, reviewing and issuing proposals and establishing a marketing strategy and procedures for the  consideration of LDCC JPB.

Appointees:
Delbert Eitel, Robert Rolston, David Garber, Edith LaMeres, Kim Cannon, Gary Elwell, and Jeff Fassett.

The most recent recommendation to LDCC Board by the Marketing Committee:  1) proceed toward finalizing the proposed Wyoming Game & Fish Lease Agreement;  2) remain open to other, as needed, short term lease proposals; 3) develop a broader water marketing policy by late summer/fall of 2012.  The Marketing Committee also outlined the need for additional public outreach and discussion of the proposed G&F lease before the LDCC Board and County Commissioners’ final action.

September 14-15, 2012 WY Game & Fish Commission meeting – Deadline by the WY Game & Fish to reach an Agreement was extended to  November 14-15, 2012.

MODELING WORK GROUP

The Modeling Work Group consists of representatives from LDCC JPB, WWDC (Wyoming Water Development Commission), M&M Ranch, Nerd Gas and WY Game & Fish.

SHORELINE PROTECTION REGULATION WORK GROUP

A Shoreline Regulation Work Group was appointed by the LDCC JPB on November 17, 2011.  The purpose of the Work Group is to draft Public Use Regulations and Private Use Regulations for the consideration of the LDCC JPB.

Appointees:
Dave Clarendon, Lucas Todd, Edith LaMeres, Paul Mavrakis, Seth Roseberry, Jack Landon, Greg Thurow, Dean Knauer, Dick Hall, Anthony Randall, Randy Bratton and  Rick Durfee.

The Shoreline Work Group met June 4, 2012 to finalize the (text) Public Use Portion of the Shoreline Regulations.  The mapping regarding the Shoreline Regulations is scheduled for completion in fiscal year 2012/2013.  Shoreline Regulations-Public Use-Jun 6 2012 CLEAN COPY from final Mtg on 05 04 12

The Shoreline Work Group has recommended that the LDCC Board pursue a declaratory judgment defining the rights within the (two) Easements prior to completing the Private Use Portion of the Shoreline Regulations.  The Board directed Attorney Cannon to move forward and report back to the LDCC JPB.

On July 19, 2012 LDCC JPB, per advisement of Attorney Cannon, opted not to move forward with a declaratory judgement. The LDCC JPB tabled further discussion.
